By creating an account, installing the Shimpilot GitHub App, or using the service, you agree to these terms on behalf of yourself and any organization you represent. If you do not agree, do not use Shimpilot.

You must be at least 16 years old and legally able to enter into a contract. If you use Shimpilot on behalf of an organization, you represent that you are authorized to bind that organization to these terms.

You are responsible for the security of your account credentials and for all activity under your account and your organization. Notify us promptly at privacy@shimpilot.com if you believe your account has been compromised.

Shimpilot accesses only the repositories you explicitly select when installing its GitHub App. You represent that you are authorized to grant that access for every repository you connect.

The GitHub App requests read access to repository contents and metadata, and write access limited to creating branches and pull requests. It does not request the ability to merge, to modify branch protection, or to administer your organization.

Your use of Shimpilot is subject to our Acceptable Use Policy, which forms part of these terms.

Your source code remains yours. Nothing in these terms transfers ownership of your code, your repositories, or your data to Shimpilot.

You grant us a limited licence to access, copy, parse, and process your repository contents solely to provide the service: scanning for affected code, generating and validating migration patches, and opening pull requests. That licence exists only for as long as you keep the repository connected.

Shimpilot generates migration proposals and reviewable pull requests. Customers remain responsible for reviewing, testing, approving, and deploying changes.

Migration patches are produced with the assistance of AI models and then checked by deterministic tooling — syntax and AST validation, type checking, your repository's own test suite where available, and a rescan. Those checks reduce risk. They do not eliminate it.

Every proposed change is delivered as a draft pull request on a new branch. Shimpilot does not merge pull requests, does not write to your default branch, and does not deploy code.

We want these limits stated plainly rather than buried in a disclaimer:

• We do not guarantee that every breaking change in an API you depend on will be detected. Coverage depends on what a provider publishes and on which call patterns Shimpilot supports.
• We do not guarantee that a generated migration is correct, complete, or safe to deploy.
• We do not guarantee that your application will not break.
• We do not guarantee any level of uptime or availability.
• We do not guarantee cost savings or prevention of incidents.

Shimpilot depends on GitHub, AI providers, and the public documentation of the API providers it monitors. We do not control those services. Changes to them, or outages in them, may affect Shimpilot's ability to detect changes or open pull requests.

Paid plans, where offered, are billed through our billing provider on the cycle shown at checkout. Fees are non-refundable except where required by law. We may change pricing with notice; changes do not apply to a billing period already paid for.

You may cancel at any time. Access continues to the end of the paid period, after which the organization reverts to the free tier.

You may stop using Shimpilot at any time by uninstalling the GitHub App. We may suspend or terminate access for breach of these terms or the Acceptable Use Policy, for suspected abuse, or where required by law — with notice where practical.

We treat the contents of your private repositories as confidential and do not disclose them except to the service providers listed on our subprocessors page, as necessary to operate the service, or where legally compelled.

Shimpilot is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

To the fullest extent permitted by law, Shimpilot is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the service — including from a migration that is incorrect, incomplete, or causes a failure in your application.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, or removes any mandatory rights you have under applicable law.

You agree to indemnify Shimpilot against third-party claims arising from your use of the service in breach of these terms, from your connecting repositories you were not authorized to connect, or from your deployment of changes proposed by Shimpilot.

If you have a dispute about the service, you can contact privacy@shimpilot.com so we can try to resolve it informally. These terms do not designate an exclusive court or jurisdiction. Applicable law determines your rights and where a claim may be brought.

We may update these terms as the product evolves. Material changes will be reflected in the "Last updated" date, and continued use after a change constitutes acceptance.
